PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THIS PLATFORM AS THEY ARE A LEGALLY BINDING AGREEMENT BETWEEN YOU AND US.
Defined terms used in these Terms: "RightGhar", "we", "us" or "our" means RightGhar Technologies Private Limited; the "Platform" means the RightGhar website, mobile applications, WhatsApp services and all associated services; a "User" is any person who accesses the Platform; an "Owner" is a User listing property they own; a "Lister" is any User (Owner or Broker) who posts a listing; a "Broker" is any real estate agent, channel partner or intermediary using the Platform; and an "Introduction" is the connection facilitated between Users via the Platform.
We are RightGhar Technologies Private Limited (CIN: U62020PN2024PTC236363), a company incorporated in India with its registered office at Perfect 10, Pune, Maharashtra. Our email address is hello@rightghar.com. We are the provider of this Platform. We are not a property sales or lettings agency and we are not a real estate agent (see Sections 1.2 and 1.3 below). It is our Users — property owners, landlords, tenants, buyers and independent Brokers — who display property details for you to view.
RightGhar is an "intermediary" within the meaning of Section 2(1)(w) of the Information Technology Act, 2000. The Platform is a neutral technology venue that allows Owners and Brokers to publish property listings and allows Users to search those listings and connect with Listers. RightGhar does not create, originate, verify the truth of, endorse, or control the substance of any listing, and does not select which User contacts which Lister. All listings and communications are third-party information hosted on behalf of Users. RightGhar merely provides access to a communication system over which such information is transmitted, stored, or hosted; it does not initiate the transmission, select the receiver, or modify the substantive content of any transmission, save for automated formatting and display. RightGhar's role is limited to facilitating Introductions; every dealing that follows an Introduction occurs off the Platform, directly between the Users concerned.
RightGhar is not a real estate agent, broker, dealer, promoter, or property adviser, and does not carry on the business of a real estate agent as defined in Section 2(zm) of the Real Estate (Regulation and Development) Act, 2016 ("RERA"). RightGhar does not negotiate, represent any party in, or act on behalf of any party to, any transaction of sale, purchase, lease, or leave-and-licence; does not introduce specific buyers and sellers to each other for negotiation for consideration; and does not receive any commission, brokerage, or fee calculated on or payable in respect of any property transaction. Any fee RightGhar charges (for example, a Broker software subscription) is a fee for access to technology and Platform features only, and is not brokerage, commission, or consideration for facilitating any property transaction. Nothing on the Platform creates any relationship of agency, partnership, joint venture, employment, or fiduciary duty between RightGhar and any User, Owner, or Broker. RightGhar is not a party to, and assumes no obligation or liability under, any tenancy, leave-and-licence, agreement for sale, brokerage arrangement, or other contract between Users.
These Terms of Use ("Terms") set out all of the rules and obligations that apply to your use of the Platform. By using our Platform, you confirm that you accept these Terms and that you agree to comply with them. If you do not agree to these Terms, you must not use our Platform.
You must be at least 18 years of age to use our Platform. By using our Platform and accepting these Terms, you confirm that you are at least 18 years of age. The Platform is not intended for, and must not be used by, persons under 18 years of age.
You accept these Terms and our Privacy Policy by a clear affirmative action — creating an account, replying "YES" (or an equivalent affirmative word) to our WhatsApp onboarding message, completing phone-OTP verification, or continuing to use the Platform after being shown these Terms. RightGhar records the date, time, phone number, and content of such acceptance as evidence of agreement, constituting a valid electronic contract under Section 10-A of the Information Technology Act, 2000. You consent to receive service and transactional communications (account, listings, verification, freshness reconfirmations, grievances) on WhatsApp, SMS, call, or email, as necessary to provide the Platform. Marketing communications will be sent only if you have separately opted in, and you may withdraw that consent at any time by replying "STOP" or using the opt-out method provided, without affecting your account or service communications.
We recommend that you download and store a copy of these Terms for future reference. They are a legally binding agreement between you and us. These Terms may also make reference to other policies that apply when using our Platform, such as our Privacy Policy.
We may from time to time change the content of this Platform or suspend or discontinue any aspect of this Platform, which may include your access to it. We may suspend, withdraw, discontinue or change all or any part of our Platform without notice. We shall not be liable if we cannot process your details due to circumstances beyond our reasonable control.
We strive to maintain Platform availability but do not guarantee uninterrupted access. We reserve the right to suspend, modify, or discontinue any part of our services for maintenance, updates, legal compliance, or business reasons, with or without notice.
You accept that you are solely responsible for ensuring that your computer system meets all relevant technical specifications necessary to use this Platform and that your computer system is compatible with this Platform.
You must not misuse our system or this Platform. In particular, you must not:
Breach of this Section may result in suspension, termination, forfeiture of paid features without refund, and legal action.
Whenever you make use of features that allow you to upload content to our Platform, or to make contact with other users via our Platform, you must comply with content standards. All content that you upload to our Platform must:

If you are acting in the course of business, unless you have our prior written consent, you may not use this Platform for the purposes of undertaking research on the property market or conducting competitive analysis.
To gain access to certain details and services on our Platform you will need to register (free of charge) as a user. You must be at least 18 years of age to register. At our discretion, we may refuse your application for registration.
Each registration is for a single user only. You must not share your username and password with any other person. You must ensure the password you use is unique and must not be re-used anywhere else. You undertake that all information provided by you for registration purposes is accurate and complete.
You accept sole responsibility for all use of and for keeping secret any password that may have been given to you or chosen by you for use on this Platform. You will notify us immediately of any unauthorized use of them or any other breach of security of this Platform of which you become aware.
We have the right to disable any account or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these Terms.
Each Lister is solely responsible for every listing it posts and warrants to RightGhar and to all Users that: (a) it has the lawful right and authority to list the property and offer it for rent or sale; (b) all information, photographs, videos, prices, and terms are true, accurate, current, and not misleading; (c) the listing and the Lister's conduct comply with all applicable laws, including RERA, the Consumer Protection Act, 2019, tax laws, and (for a Broker) its RERA registration and disclosure obligations; and (d) the listing infringes no third party's rights. RightGhar does not verify listings and gives no warranty as to their accuracy. The Lister shall indemnify RightGhar for any breach of these warranties. RightGhar may, but need not, remove, pause, or decline any listing at its discretion, including under the freshness mechanism or on receipt of a complaint or lawful order.
RightGhar may display badges such as "Listed by Owner," "Verified Owner," or "Verified Broker," and may show a Broker's RERA registration number where the Broker has provided one. Any such badge indicates only that, at the time of the check, RightGhar or its KYC service provider recorded certain documents or data points (such as a phone number, PAN, or an Aadhaar offline verification) submitted by the User, in the limited manner described in our Privacy Policy. A badge is a record of a documentary or data check only. It is not a guarantee, warranty, or endorsement of the User's identity, honesty, solvency, authority to let or sell, ownership or title, the accuracy of any listing, the validity or subsistence of any RERA registration, or the outcome of any dealing. RightGhar does not independently authenticate title deeds, ownership, or the continuing validity of any RERA number. You must independently verify all credentials before dealing with any User or Broker.
Where a listing shows it was "reconfirmed" within a stated number of days, this means only that the Lister responded to an automated reconfirmation prompt (e.g., a WhatsApp "freshness ping") within that period, or that RightGhar auto-paused the listing for want of a response. A reconfirmation is a record that the Lister indicated the listing was still current; it is not a verification, warranty, or guarantee that the listing, price, availability, or any other detail is accurate, lawful, or genuine. RightGhar does not guarantee the accuracy, currency, or continued availability of any listing and accepts no liability for reliance on any freshness indicator.
A Broker using the Platform does so as an independent business and is solely responsible for its own compliance with all laws applicable to real estate agents, including obtaining and maintaining registration under Section 9 of RERA where required, and quoting its RERA registration number and displaying the QR code and prescribed particulars in its advertisements and listings as required by the relevant Authority (including MahaRERA Order No. 46C/2025 dated 8 April 2025 and Rule 14(2) of the Maharashtra RERA Rules, 2017). RightGhar does not verify, and is not responsible for, whether any Broker is validly registered or compliant. Displaying a Broker's RERA number on the Platform is a convenience reproduction of information supplied by the Broker and is not a representation by RightGhar that the registration is valid or subsisting. The Broker shall indemnify RightGhar against any claim, penalty, or proceeding arising from its non-compliance, listings, representations, or conduct.
All negotiations, agreements, payments, deposits, site visits, verifications, and transactions between Users (including between a renter and an Owner, and between any User and a Broker) take place solely between those Users, off the Platform and at their own risk. RightGhar is not a party to and has no involvement in, control over, or responsibility for: the existence, condition, ownership, title, legality, safety, or habitability of any property; the accuracy of any listing; the identity, character, solvency, conduct, or RERA-registration status of any User or Broker; the terms or performance of any agreement; the payment, refund, or non-refund of any rent, deposit, token, brokerage, or other money; or any loss, fraud, misrepresentation, injury, or dispute arising from such dealings. You acknowledge that RightGhar does not conduct police verification, background checks, title searches, or physical inspection of any property or person, and that you must independently verify all facts, documents, ownership, and credentials before parting with any money or entering any agreement. You assume all risk arising from your use of the Platform and from any Introduction, meeting, communication, or transaction with any other User or Broker.
RightGhar will never ask you to pay rent, a deposit, a token, or a brokerage to RightGhar, and does not collect or hold any such money. Never pay any money, share OTPs, or sign any document before you have personally inspected the property, verified the other person's identity and ownership or authority, and confirmed all details independently. Be cautious of anyone who demands advance payment to "block" a property, refuses a physical visit, offers prices far below market, or asks you to transact outside a documented process. Report suspected fraud to our Grievance Officer (see Section 17) and to the police/cyber-crime authorities. RightGhar is not responsible for losses arising from your failure to take these precautions but will cooperate with lawful investigations.
Disputes between Users are private matters between those Users. RightGhar is not obliged to, and generally will not, mediate, arbitrate, adjudicate, or take sides, and is not liable for their resolution or outcome. It may, at its discretion and without obligation, provide non-binding assistance.
We reserve the right to bar users from this Platform and/or restrict or disable their access or use of any or all elements of our services, on a permanent or temporary basis at our sole discretion.

We will determine in our discretion whether there has been a breach of these Terms. Where we believe a breach has occurred we may take such action as we deem appropriate, including:
We reserve the right to take down any content that you upload to our Platform at any time without notice and without having to give a reason. On receipt of a court order or a notification from an authorised government agency that any content is unlawful, we will disable or remove such content within thirty-six (36) hours.
Our Platform is directed to people residing in India. We do not represent that content available on or through our Platform is appropriate for use or available in other locations.
This Platform is designed for users located in India and operates under Indian jurisdiction. All content, services, and interactions on this Platform are governed by Indian laws and regulations, including but not limited to:
If you access our Platform from outside India, you do so at your own risk and are responsible for compliance with local laws in your jurisdiction. We make no representation that our Platform complies with laws outside of India.
The copyright and all other intellectual property rights in this Platform (including all database rights, trademarks, service marks, trading names, text, graphics, code, files, links and other materials published on it) belong to us or our licensors. All rights are reserved.
By uploading content to our Platform, you grant us a non-exclusive, royalty-free licence to host, store, reproduce, format, display and distribute that content for the purposes of operating the Platform and providing our services. Any use of your content for marketing or promotional purposes is governed by our Privacy Policy and occurs only with your separate consent or in aggregated/anonymised form. We also have the right to disclose your identity to any third party who claims that content posted or uploaded by you to our Platform breaches their legal rights.
Subject to your compliance with these Terms:
If you are a business, you must not copy, transmit, modify, republish, store (in whole or in part), frame, pass-off or link to any material or information on or downloaded from this Platform without our prior written consent.
Our registered trademarks include "RIGHTGHAR" and associated logos. You must not use or copy them without our prior written consent.
We respect intellectual property rights and will remove infringing content when properly notified. We may terminate accounts of repeat infringers and take appropriate legal action.
The Platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, RightGhar disclaims all warranties, express or implied, including as to accuracy, completeness, reliability, merchantability, fitness for a particular purpose, non-infringement, uninterrupted or error-free operation, and freedom from viruses. RightGhar does not warrant that any listing is genuine, that any property exists or is available, or that any Introduction will result in a tenancy, sale, or any outcome. Nothing excludes any warranty or condition that cannot be excluded under applicable Indian law.
The information provided on this Platform is for general interest only and does not constitute specific advice. Although we make reasonable efforts to update information on our Platform, we make no representations, warranties or guarantees, whether express or implied, that the content on our Platform is accurate, complete or up to date.
We are not a real estate agency. The details of the properties available on this Platform are provided to us by our Users for your information only. We do not verify the property details provided to us and give no warranties or representations as to their accuracy or completeness. If you rely on these details, you do so at your own risk. See also Sections 5 (badges and freshness) and 6 (assumption of risk).
This Platform contains links to websites operated by third parties. We have no control over their individual content. We give no warranties or representations as to the accuracy or completeness of any information appearing in relation to any linked websites.
To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to our Platform or any content on it, whether express or implied.
Nothing in these Terms excludes or limits our liability where it would be unlawful to do so. This includes liability for:
Subject to Section 11.1, and to the maximum extent permitted by law, RightGhar is not liable for any act, omission, default, misrepresentation, fraud, or conduct of any User, Owner, Broker, or third-party provider, or for any transaction, dealing, or dispute between Users. If you choose to contact other Users using the Platform, your details will be sent to them; we do not accept any liability for any subsequent communications or dealings between you and other Users.
Subject to Section 11.1, the Platform is a free venue except for specific paid features, and RightGhar is not liable for any indirect, incidental, special, consequential, or punitive loss, or loss of profit, business, goodwill, data, or opportunity.
We will not be liable for any failures due to:
Subject to Section 11.1, RightGhar's total aggregate liability to any User for all claims arising in any twelve-month period shall not exceed the higher of (i) the total fees actually paid by that User to RightGhar for paid Platform features in that period, or (ii) ₹5,000 (Rupees Five Thousand). This limitation does not affect any mandatory statutory remedy available to you.
You agree to indemnify, defend, and hold harmless RightGhar, its directors, officers, employees, and agents from all claims, demands, actions, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use or misuse of the Platform; (b) any listing, content, or communication you post or send; (c) any transaction, dealing, or dispute between you and any other User or Broker; (d) your breach of these Terms or of any law (including RERA, tax, consumer, and data-protection laws); or (e) your infringement of any third party's rights. This indemnity survives termination.
Our Platform is made available free of charge for basic services. We may charge fees for specific optional paid features (such as Broker software subscriptions). Any fee we charge is a fee for access to technology and Platform features only, and is not brokerage, commission, or consideration for facilitating any property transaction.
RightGhar does not collect, hold, or process rent, security deposits, token amounts, brokerage, or any other money payable between Users. Any payment between Users (including between a renter and an Owner, or between a User and a Broker) is made entirely outside the Platform, directly between those Users, and at their own risk.
RightGhar offers optional paid software subscriptions to Brokers under a transparent, published national rate card. All prices are stated exclusive of tax; GST at the applicable rate (currently 18%) is charged in addition and shown as "+GST" on every price and invoice. Subscription fees are fees for access to Platform technology and features only, and are not brokerage or commission.
Where a User enquires about a specific listing, that enquiry is routed only to the Lister of that listing. Such a lead is an Introduction only — the contact details of a User who has chosen to enquire about that listing. RightGhar does not sell the same lead to more than one Broker, and does not operate any shared-lead model. RightGhar gives no warranty that any lead is genuine, reachable, serious, or will result in any outcome, and is not responsible for the enquiring User's conduct. The Broker must handle all lead data in compliance with the Digital Personal Data Protection Act, 2023 and use it only to respond to that enquiry.
RightGhar may offer a feature by which a renter can choose to have their stated requirement shared with one or more eligible Brokers. This happens only where the renter gives specific, informed consent to that sharing at the time, in accordance with the Digital Personal Data Protection Act, 2023, and the renter may decline or withdraw at any time. A Broker is eligible only if it holds valid RERA registration where required and meets RightGhar's published performance and conduct criteria; RightGhar may suspend eligibility at its discretion. Routing a requirement is an Introduction only. RightGhar is not the renter's agent, does not negotiate on the renter's behalf, gives no guarantee as to any Broker's conduct, competence, or compliance, and is not liable for any dealing between the renter and any Broker. RightGhar receives no brokerage or transaction-linked commission for such routing.
RightGhar may list or refer optional services provided by independent third-party providers, such as rent-agreement drafting and registration, packers and movers, cleaning, tenant/background verification, and home-loan referrals. For these services RightGhar acts only as a referrer or marketplace that introduces you to the provider. The service contract is solely between you and the provider. RightGhar does not itself provide these services, is not a party to that contract, and does not guarantee the provider's quality, timeliness, pricing, legality, or outcome.
Fees for paid features are non-refundable except as specifically stated in the applicable feature terms or as required by law. Refund terms, where applicable, are provided at the time of purchase. Nothing in this Section affects a consumer's non-excludable statutory rights.
This Platform contains links to websites operated by third parties. The links are for your convenience only. We do not recommend any products or services advertised on those websites. If you decide to access any third party website linked from this Platform, you do so at your own risk.
You must not include links to this Platform in any other website, application or computer program without our prior written consent. In particular, you must not include any "deep link" to any page on this Platform.
Our Platform must not be framed on any other site. You must not load any images or any other assets directly from this Platform onto any other website without our prior written consent.
When you fill out and submit forms on our Platform, your personal information will be processed in accordance with our Privacy Policy, which forms part of these Terms.
Our collection, use and processing of your personal data is described in our Privacy Policy, and is based on your consent and the legitimate uses permitted under the Digital Personal Data Protection Act, 2023.
RightGhar may suspend, restrict, or terminate your access, remove or pause any listing, or revoke any badge, at its reasonable discretion, with or without notice, including for breach, suspected fraud or unlawful activity, misuse, non-payment, a lawful order, or to protect the Platform or its Users.
You may stop using the Platform and request account closure at any time by following the account deletion procedures provided on the Platform or by contacting us directly.
Upon termination:

RightGhar has appointed a Grievance Officer in accordance with the IT Rules 2021:
The Grievance Officer will acknowledge any complaint within twenty-four (24) hours and dispose of it within fifteen (15) days. Complaints regarding content of the nature described in Rule 3(1)(b) of the IT Rules 2021 (other than intellectual-property or unlawful-information matters) will be resolved within seventy-two (72) hours. Content in the nature of non-consensual or sexually explicit imagery or impersonation will be addressed within twenty-four (24) hours of complaint. On a court order or an authorised government-agency notification that content is unlawful, RightGhar will disable or remove it within thirty-six (36) hours. A complainant dissatisfied with the decision may appeal to the Grievance Appellate Committee under Rule 3A of the IT Rules 2021 within thirty (30) days.
For any paid service, RightGhar's grievance officer will acknowledge the complaint within forty-eight (48) hours and redress it within one (1) month, in accordance with the Consumer Protection (E-Commerce) Rules, 2020.
These Terms, their subject matter and their formation, are governed by the laws of India. Subject to the arbitration provision below, the courts at Pune, Maharashtra have exclusive jurisdiction, and nothing herein affects a consumer's right to approach the consumer disputes redressal commissions under the Consumer Protection Act, 2019.
Any dispute between RightGhar and a Broker or business User arising out of a paid subscription or commercial arrangement shall be referred to a sole arbitrator under the Arbitration and Conciliation Act, 1996; the seat and venue of arbitration shall be Pune, and the language of arbitration shall be English.
The arbitration provision above does not apply to, and shall not be used to compel arbitration of, any dispute raised by a User who is a "consumer" under the Consumer Protection Act, 2019. Such a User retains the unqualified right to pursue remedies before the consumer commissions and any other competent forum, and may choose arbitration only if it voluntarily agrees after the dispute has arisen.
The current version of these Terms, with its "Last Updated" date, is always available on the Platform. For material changes, we will give reasonable prior notice on the Platform and/or by message to your registered WhatsApp/email. Continued use after a change takes effect is acceptance of the changed Terms; if you disagree, stop using the Platform and you may close your account.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full effect and the invalid provision shall be read down to the minimum extent necessary to make it valid.
Failure to enforce any right under these Terms is not a waiver of that right.
You may not assign or delegate any rights or obligations under these Terms without our consent. We may assign these Terms to a successor entity on notice to you.
We shall not be liable for any failure or delay caused by events beyond our reasonable control, including internet or infrastructure failure, cyber-attack, power failure, natural disaster, epidemic, strike, or governmental or regulatory action.
These Terms, together with our Privacy Policy and any feature-specific terms, constitute the complete agreement between you and us regarding the use of our Platform.
